Terms of Use and Sale

These General Terms govern the use of jsbcloud.com and the sale of services offered by JSBCloud. By using our site or placing an order, you agree to these terms in their entirety.

1. Legal Information

The site is hosted by ALTISCORE at the Equinix PA5 datacenter (Paris).

2. Service Description

JSBCloud offers hosting services including:

  • VPS (Virtual Private Server)
  • Web hosting
  • Reseller hosting
  • Gaming dedicated services
  • Domain name management

Features of each service are detailed on the corresponding product pages.

3. Account Creation

To order, the Customer must create a client area with confidential login credentials. The Customer agrees to:

  • Provide accurate and up-to-date information
  • Maintain confidentiality of credentials
  • Inform JSBCloud of any loss or fraudulent use
  • Not distribute illegal or harmful content

Registration is reserved for adults with legal capacity. Minors must act under parental supervision.

4. Orders

Offers are valid while supplies last. If unavailable after ordering, the Customer may choose:

  • An equivalent service
  • Refund within 30 days

The ordering process involves:

  1. Service selection and cart addition
  2. Cart verification and validation
  3. Acceptance of these terms
  4. Payment and confirmation

A confirmation email is sent with order details. The invoice is available in the client area.

5. Payment

Accepted payment method:

  • Credit card (via Stripe, SSL secured payment)

Prices are shown in euros excluding VAT, unless otherwise indicated. Payment is due at order.

Automatic renewals: The Customer manages renewals via their client area. In case of double billing due to unsynchronized renewals, the surplus will be credited to the account (no refund).

Billing: Invoices are generated 15 days before due date. Once generated, the invoice is due even if the service is canceled (service cancellation does not cancel the invoice). To avoid being billed, the Customer must open a ticket to request cancellation before the invoice is generated.

6. Service Activation

Services are activated within a maximum of 30 business days after payment validation (unless otherwise indicated). The Customer receives by email:

  • Login credentials
  • Usage instructions

In case of problems, report within 7 days via support. JSBCloud may suspend access for non-compliance with terms or payment default.

7. Right of Withdrawal

In accordance with French Consumer Code Article L.221-18, the Customer has 14 days to withdraw, except for:

  • Services fully executed before the deadline
  • Digital content whose execution has started with Customer consent

By accepting immediate activation (VPS, hosting, etc.), the Customer expressly waives their right of withdrawal (Article L.221-28 of the French Consumer Code).

9. Intellectual Property

All website elements (texts, images, JSBCloud/AltisCore logos, etc.) are protected by intellectual property law.

Any reproduction, modification, or exploitation without written authorization is prohibited. The Customer retains ownership of their content and grants JSBCloud a non-exclusive license for its use within the service.

10. Prohibited Activities and Fair Use Policy

The use of JSBCloud services is subject to compliance with our acceptable use policy. The following are prohibited:

  • Illegal content (piracy, counterfeiting, etc.)
  • Malicious activities (spam, phishing, malware, DDoS)
  • Content harmful to individuals
  • Resource abuse (unauthorized cryptocurrency mining, etc.)

Violation of these rules results in immediate service suspension without refund and may be reported to the relevant authorities.

By ordering from JSBCloud, every user agrees to comply with our Fair Use Policy which defines the conditions for reasonable use of resources (bandwidth, CPU). Non-compliance with this policy may result in service limitation or suspension.

11. Suspension and Termination

Non-payment: In case of non-payment, the service is suspended 2 days after the due date. The service is permanently terminated and data deleted 7 days after the due date.

Data recovery: No copy of data can be provided until the invoice is paid. After termination and service deletion, data is no longer recoverable.

Termination by JSBCloud: JSBCloud reserves the right to suspend or terminate any service in case of violation of these terms, including prohibited activities, without notice or refund.

Forfeiture of credits upon violation: In case of termination for violation of these terms (prohibited activities, non-compliance with the Fair Use Policy, fraud, abusive behavior, etc.), any credit, balance, prepaid amount or any other remaining amount on the Customer's account is permanently forfeited and will not be subject to any refund, compensation or transfer. The Customer expressly waives any claim regarding these amounts.

12. Data Backup

Data backup is entirely the Customer's responsibility. JSBCloud cannot be held responsible for any data loss, regardless of the cause. It is the Customer's responsibility to implement their own backup solutions.

13. Liability and Limitation

Availability Guarantee (SLA): JSBCloud commits to a 99% availability rate for its hosting services. If this commitment is not met, the Customer may request compensation in the form of service credit (not refund) by opening a ticket within 7 days of the incident. This guarantee excludes scheduled maintenance, force majeure, and interruptions caused by the Customer.

Limitation of liability: In case of a major outage attributable to JSBCloud, compensation is limited to a refund of the current month. If the Customer wishes to keep their service, the following month is provided free of charge. JSBCloud cannot be held responsible for data loss (see article 12).

JSBCloud does not guarantee uninterrupted operation (maintenance, technical updates). The Customer acknowledges that:

  • The Internet cannot guarantee total transmission security
  • They are responsible for hosted content
  • They must have secure computer equipment

JSBCloud is not responsible for content hosted by Customers or damages caused by non-compliant use.

14. Price Revision

Prices are guaranteed for the duration of the current subscription. JSBCloud reserves the right to modify its prices with 30 days' notice, notified by email.

In accordance with Article L442-2 of the French Commercial Code prohibiting sales at a loss, JSBCloud may adjust its prices in case of increased supplier costs (infrastructure, energy, licenses, etc.).

15. Legal Warranties

Services benefit from the legal warranty of conformity (French Consumer Code Articles L.217-4 et seq.) and the warranty against hidden defects (French Civil Code Articles 1641 to 1649).

Action period: 2 years from service delivery.

The site may contain links to third-party sites. JSBCloud is not responsible for their content. Use of these sites is at the user's own risk.

18. Modifications

JSBCloud reserves the right to modify these terms at any time. In case of significant changes, Customers will be notified by email. The applicable terms are those in effect at the date of order.

These terms are governed by French law. Any dispute falls under the jurisdiction of French courts.
